El embargo es una medida cautelar típica, su naturaleza es de aseguramiento y se aplica en todos los proceso en donde se tiene que garantizar el resultado económico de la sentencia o ejecución.

Comentarios Generales sobre derecho de familia
El Divorcio en Costa Rica, está regulado en el artículo 48 y siguientes del Código de Familia.
Como Causales del Divorcio se establecen: el adulterio, el atentado contra la vida del cónyuge o los hijos, tentativa de prostitución o corrupción al otro cónyuge y a los hijos, la sevicia, entendida esta como maltrato físico o psicológico, la separación judicial por un término mayor a un año, la ausencia del cónyuge legalmente declarada, la separación de hecho por un termino no menor de tres años, y el Mutuo Consentimiento de ambos cónyuges.
